WorkSafeBC requires most employers to establish a Joint Health and Safety Committee (JHSC) or a Worker Health and Safety Representative, depending on the number of workers they employ. The primary goal of a JHSC is to involve both workers and employers in identifying and resolving health and safety issues in the workplace.

Here's a breakdown of the key requirements:
1. When a JHSC is Required:
  • 20 or more workers: If you regularly employ 20 or more workers, you must establish a Joint Health and Safety Committee.
  • 10-19 workers: If you regularly employ 10 to 19 workers, you must have a Worker Health and Safety Representative. (A JHSC can be established voluntarily in these cases as well.)
  • Less than 10 workers: A representative is not legally required, but employers still have a responsibility to consult with workers on health and safety matters.
2. Committee Composition:
  • Minimum of 4 members: For a JHSC, there must be at least four members.
  • Worker Representation: At least half of the committee members must be workers who are not associated with management.
  • Co-Chairs: The committee must have two co-chairs, one selected by the worker members and one by the employer members.
  • Selection:
    • Worker Members: Must be selected by the workers they represent (e.g., through election or by the union).
    • Employer Members: Must be selected by the employer.
3. Training Requirements:
  • Mandatory Training: All JHSC members, and worker health and safety representatives, must receive training.
  • Level 1 Training: Each new JHSC member must complete eight hours of training (Level 1) as soon as practicable, but no more than six months after becoming a member.
  • Level 2 Training: At least one worker co-chair and one employer co-chair, or their alternates, must complete an additional eight hours of training (Level 2).
  • Training Providers: Training must be provided by an agency acceptable to WorkSafeBC. WorkSafeBC offers resources and lists approved training providers.
4. Committee Functions and Duties:
The JHSC has several important duties, including:
  • Identifying Hazards: Regularly inspecting the workplace to identify potential hazards to workers.
  • Investigating Incidents: Investigating incidents, accidents, dangerous occurrences, and occupational diseases.
  • Making Recommendations: Making recommendations to the employer and workers for improving health and safety.
  • Reviewing Programs: Participating in the development and review of the employer's occupational health and safety program.
  • Education and Training: Promoting health and safety education and training for workers.
  • Meetings: Holding regular meetings (at least once a month, or more often if necessary) and keeping minutes of these meetings.
  • Responding to Concerns: Receiving and responding to health and safety concerns and complaints from workers.
5. Employer Duties Regarding the JHSC:
Employers have specific responsibilities towards the JHSC, including:
  • Cooperation: Cooperating with the committee in performing its duties.
  • Information Sharing: Providing the committee with the information it needs to fulfill its responsibilities.
  • Responding to Recommendations: Responding to the committee's recommendations in writing within 21 days, outlining what actions will be taken or why no action will be taken.
  • Providing Resources: Providing resources and time for members to carry out their duties and attend training.
  • Posting Information: Posting the names and contact information of committee members or the representative, and the minutes of committee meetings​
