PRIME CONTRACTOR RESPONSIBILITIES
If your business hires contractors, it is important to know that some contractors may be your workers. This means you would be responsible for them as their employer and you would be required to pay premiums for their WorkSafeBC coverage. The owner of a workplace is an important part of the prime contractor process in BC. It is the owner that assigns prime contractor status through a written agreement and if that agreement isn’t in place, the owner is the prime contractor.
According to Section 118 of the Workers Compensation Act; in a workplace where there are two or more employers working at the same time, a written agreement must identify a prime contractor. If there is no written agreement, the owner is considered to be the prime contractor. While prime contractors have overall responsibility for health and safety on a work site, employers still retain responsibility for the health and safety of their own workers.
